Policies

Arrival Time:  Your pool time has been scheduled just for you.  Please arrive prior to your start time to allow time to change and to be ready to swim.  If you are late, we will give you as much of your scheduled time as possible, up to your scheduled end time.  We expect our other guests to also be “on time” for their session and would like to ensure they have full use of the facility during their scheduled time.  Please park on the street or in the designated area during the winter.

Risk:  For pool rental time, the pool is a “No Lifeguard on Duty” pool although an attendant is on duty at all times a swimmer is in the water.  Swimming is at your own risk.  All Swim School lessons are taught by a certified lifeguard and experienced instructor. Swimmers (or their parents as applicable) attest they are in good health and are cleared by a doctor and able to perform swimming as a sport.  Please advise the attendant of any relevant health conditions prior to swimming and list the conditions on the written copy of the policies.

Minors: All swimmers under the age of 18 must be accompanied by a parent or guardian during their swim time. At no time will any Winning Swimming staff or family member be left alone with a minor swimmer. All swimmers who are not confidently potty trained are required to wear 2 swim diapers during their session. Please change your minor swimmers in the bathroom and wash hands after using the bathroom or changing diapers.

Shower:  New Hampshire state law requires all swimmers to shower prior to using the pool. A shower is provided for your convenience. Also, please remember to wash hands after using the toilet or changing diapers to help prevent the spread of germs.

Speed Adjustment and Equipment Use:  The speed of the pool and the use of the video recording equipment and cameras will be adjusted and monitored by the facility attendant.  If you need any changes to the swim current or video equipment during your session please ask the attendant on duty for assistance.

We encourage goggles for swimmers in swim school levels beyond purple and swimmers using the current as well as swim caps for swimmers with hair below their ears or anyone sensitive to getting water in their ears. Please tie back hair that hangs below the ears.

Swim School levels above the purple level utilize bracelets to reward the swimmers for a job well done when progressing to the next skill. The bracelets are the swimmer’s responsibility to keep safe and should be worn to every lesson. Bracelets that are broken or lost will need to be replaced by the swimmer at a cost of $5 per replacement beyond the first occurrence. The bracelet is a required piece of equipment.

Illness:  If the swimmer is not feeling well, please let Coach Caron know what symptoms they have.  Depending on symptoms and what is currently “going around”, we may postpone their swim until the next scheduled time.  If the swimmer is ill with a fever or diarrhea, they cannot swim until they have been symptom free for 24 hours.  If the swimmer has a contagious illness, they cannot swim until cleared by a doctor.

Multiple Session Packages:  Multiple session packages will be issued an online punch card which will expire six months from the date of issuance.  Punch cards are nontransferable, nonrefundable, and will not be replaced if lost or stolen.  All sessions must be scheduled at least 24 hours in advance (no drop in times are available) and can be done in person, over the phone, or at www.WinningSwimming.com .

Cancellations: Cancellations or changes to an already scheduled session need to be communicated to Winning Swimming at least 24 hours ahead of the scheduled swim time by cancelling in the schedule, calling (603) 424-4100, or emailing Carolanne@WinningSwimming.com. Cancellations or changes within 24 hours of the scheduled time of the swim will be considered “No show” appointments and will be charged the cost of an individual appointment in that service category.  Any balances from cancellations will be due at the time of the next swim or within 30 days, whichever is sooner.

Continuation:  Winning Swimming assumes you will continue your instruction until your goals are met.  Multiple session packages (see above) are offered as a cost effective solution to paying for your instruction and do not assume your instruction will stop once the punch card is used or expired.  If you wish to discontinue your lessons, please notify Winning Swimming 30 days in advance so we may have time to tie up your skills currently being worked on and give a proper evaluation and plan of action.

Weather:  In the event of a power outage, the pool current will not circulate so appointments will be rescheduled for a later time.  We will notify you as soon as we know an outage will affect your appointment.  Luckily our power lines are buried so power outages are rare in our neighborhood.  In the event of a thunder or lightning storm, the pool will be closed for ½ hour from the last thunder clap or lightning sighting.  This is for your safety.  Again, if a storm should affect your appointment, we will let you know as soon as possible and will reschedule for a later time.

Change: Policy changes may occur without prior notice and current policies will be posted at the facility and at www.WinningSwimming.com.  Please request a copy of the current policies if desired.

Legal Requirements:

NOTICE TO BUYER: DO NOT SIGN THIS CONTRACT UNTIL YOU HAVE READ ALL OF IT. ALSO, DO NOT SIGN THIS CONTRACT IF IT CONTAINS ANY BLANK SPACES.  STATE LAW REQUIRES THAT THIS HEALTH CLUB REGISTER WITH THE BUREAU OF CONSUMER PROTECTION AND ANTITRUST OF THE DEPARTMENT OF JUSTICE AND MAY REQUIRE THAT THIS CLUB POST A BOND TO PROTECT CUSTOMERS WHO PAY IN ADVANCE FOR MEMBERSHIP OR SERVICES IN THE EVENT THIS CLUB CLOSES. YOU SHOULD ASK TO SEE EVIDENCE THAT THIS CLUB HAS EITHER POSTED A BOND IN COMPLIANCE WITH THE LAW OR HAS BEEN EXEMPTED FROM THIS REQUIREMENT BY THE ATTORNEY GENERAL BEFORE YOU SIGN THIS CONTRACT. IF THIS CLUB HAS NOT POSTED SUCH A BOND, AND YOU PAY THIS HEALTH CLUB FOR MORE THAN ONE MONTH’S MEMBERSHIP OR SERVICES IN ADVANCE, THEN YOU ARE PAYING FOR FUTURE SERVICES, AND YOU MAY BE RISKING THE LOSS OF YOUR MONEY IN THE EVENT THAT THE CLUB CEASES TO CONDUCT BUSINESS.  YOU MAY CANCEL THIS TRANSACTION IN WRITING ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION.  Buyer’s Rights. – I. Every seller of a prepaid health club services contract shall: (a) Refund to the buyer the pro rata cost of any unused services, within 15 days after request therefore, if: (1) The buyer is unable to receive benefits from the seller’s services by reason of death or disability. The health club may require that the disability be confirmed by an examination of a physician agreeable to the member and the health club; provided, however, that this subparagraph shall not operate to prevent the buyer from proving the disability in a judicial proceeding; or (2) The seller relocates his facility more than 8 miles from its present location, or the services provided by the seller are materially impaired. (b) Refund to the buyer the pro rata cost of any unused services under all contracts between the parties, within 15 days after request therefore, if the aggregate price of all contracts in force between the parties exceeds $1,000. Provided, however, if the contract so provides, the seller may retain a cancellation fee of not more than 25 percent of the pro rata cost of unused services on all contracts, not to exceed $250. (c) Refund to the buyer the pro rata cost of any unused services within 15 days after the club ceases operation. II. Upon the occurrence of any of the circumstances enumerated in subparagraphs I(a) or (b) or (c) of this section, the buyer or his estate shall be relieved of any further obligation for payment under the contract not then due and owing.
